Plain language summary. Use Tuiscint as a journal. It is not a medical device or a diagnostic tool. We provide it as-is and do our best to keep it working. Your data stays on your device. If you have a real medical concern, please talk to a clinician, not an app.
1. Acceptance
By downloading, installing, or using Tuiscint (the "App") or browsing tuiscint.app (the "Site"), you agree to these Terms of Use. If you do not agree, please do not use the App or Site.
2. License to use the App
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on iPhone devices you own or control, in accordance with the App Store Terms of Service set by Apple. You may not redistribute, resell, reverse-engineer, decompile, or attempt to extract the source code of the App, except where prohibition is barred by applicable law.
3. Apple App Store terms
The App is distributed through Apple's App Store. Apple's Licensed Application End User License Agreement applies to your installation and use of the App, in addition to these Terms. Where the two are inconsistent, Apple's EULA controls. Apple is not a party to these Terms and is not responsible for the App or its content, but is a third-party beneficiary entitled to enforce these Terms against you.
4. Not medical advice
Tuiscint is a personal journaling tool. It is not a medical device, a diagnostic instrument, or a substitute for professional medical, psychological, or therapeutic advice. The pattern observations generated on your device are exploratory and statistical in nature, not clinical conclusions. If you are concerned about your physical or mental health, please consult a qualified clinician.
In an emergency, contact your local emergency services. In the United States, the 988 Suicide and Crisis Lifeline can be reached by calling or texting 988. Outside the United States, please use your country's equivalent service.
5. Your content
You retain all rights to what you write in Tuiscint. Because your entries remain on your device, we receive no license to them, request none, and would not be able to act on one if granted.
6. Acceptable use
You agree not to use the App or Site to:
- Violate any applicable law or regulation.
- Infringe the intellectual property or privacy rights of others.
- Attempt to disrupt, probe, or compromise the App or Site.
7. Price and availability
Tuiscint is available on the App Store for the price stated there at the time of download. Future versions may introduce optional paid features. Where they do, the price and terms will be presented to you before any purchase. Availability may vary by country and may change without notice.
8. Disclaimers
The App and Site are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We do not warrant that the App or Site will be error-free, secure against all threats, or that defects will be corrected, beyond a reasonable best effort.
9. Limitation of liability
To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the App or Site. Our total liability for any direct damages will not exceed the amount you paid for the App in the twelve months preceding the event giving rise to the claim.
Some jurisdictions do not allow these exclusions. Where they do not, the exclusions above will not apply to you to the extent they are unenforceable.
10. Termination
You may stop using Tuiscint at any time by deleting the App from your device. We may suspend or terminate access to the App or Site if we reasonably believe you have violated these Terms.
11. Changes
We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Material changes will be highlighted within the App on next launch where practicable. Continued use of the App or Site after a change constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which the developer of Tuiscint is resident, without regard to its conflict-of-law provisions. To the extent permitted by law, any dispute arising from these Terms will be resolved in the courts of that jurisdiction. This does not deprive consumers of mandatory protections under the laws of their country of residence.
